 The act came into law in 1950.  Only congress can create laws.  Only the president can execute them when needed.  This act is being modernized to work with the Patriot Act.  And which congress enacted the Patriot Act?  Just guess. Which president brought it into being?
On the other hand  "Those who  surrender liberty for security deserve neither." - Ben Franklin.  It is too late.  The Patriot Act is too big to fail.
